Natsuko: こんにちは、なつこです。
Naomi: なおみです。
Chris: Chris here. Tipping the Japanese Scales of Justice.
Naomi: このレッスンは、前回のレッスンの続きですよね。裁判員制度についてお話します。
Natsuko: はい、前回は、報道番組のスタジオでの会話でしたが、今回は、実際に裁判員として裁判員裁判に参加した人のインタビューが聞けるようですよ。
Naomi:裁判員裁判…。
Chris: In the previous lesson, we heard the conversation that took place on TV. This time, we'll hear from someone who really had the experience of being the citizen judge.
Natsuko: 前半は、レポーターが裁判員経験者にインタビューしています。後半は、インタビューについて、司会のアナウンサーと大学教授が話しをしています。
Naomi: 真面目なテレビ番組なので、丁寧な日本語で話していますね。
Chris: In the first episode of this lesson you’ll hear a reporter interviewing someone who has been a citizen judge. In the second half, you’ll hear an announcement of that conversation between a college professor and an announcer.
Natsuko: それでは、聞いてみましょう。
DIALOGUE
アナウンサー:では、次に、実際に裁判員裁判に裁判員として参加された方のインタビューをご覧ください。
（インタビュー）
レポーター:裁判員として、初めて裁判に参加されたご感想をお聞かせ願えますか。
裁判員経験者:「怖い・・・」というのが正直な感想です。
もし、間違った判断をしたら、被告の人生を狂わせてしまうかもしれないわけですから。
レポーター:今回の判決には裁判員の意見が反映されたと思いますか。
裁判員経験者:そうですね・・・そう思います。
裁判官の方は法律的なことをわかりやすく説明してくれましたし、意見を言いやすい雰囲気を作ってくれました。
レポーター:お疲れのところ、ありがとうございました！
（スタジオ）
アナウンサー:佐賀教授、このインタビューをお聞きになって、いかがでしょうか。
佐賀教授:人を裁くのが怖いと感じるのは当たり前のことですよね。
特に、死刑や無期懲役の判決をしなければならないような事件の場合、裁判員の心理的な負担は大きいと思います。
アナウンサー:時間的な負担も大きいでしょうね。
佐賀教授:そのとおりです。
ですから、いろいろな面で裁判員をサポートする体制の確立が急務だと思います。
Natsuko: 次は、英語が入ります。
アナウンサー:では、次に、実際に裁判員裁判に裁判員として参加された方のインタビューをご覧ください。
Chris: And now, let's watch an interview with someone who actually has presided over a trial as a citizen judge.

レポーター:裁判員として、初めて裁判に参加されたご感想をお聞かせ願えますか。
Chris: Can we hear your thoughts on participating in a trial for the first time as a citizen judge?
裁判員経験者:「怖い・・・」というのが正直な感想です。
Chris: My honest impression is that it was scary.
裁判員経験者:もし、間違った判断をしたら、被告の人生を狂わせてしまうかもしれないわけですから。
Chris: If you make a mistake in your judgment, then it could mess up the defendant's life.
レポーター:今回の判決には裁判員の意見が反映されたと思いますか。
Chris: Do you think the sentence this time reflected the citizen judges' opinions?
裁判員経験者:そうですね・・・そう思います。
Chris: Well, yes...I do think so.
裁判員経験者:裁判官の方は法律的なことをわかりやすく説明してくれましたし、意見を言いやすい雰囲気を作ってくれました。
Chris: The judge explained legal points in a way that was easy to understand and created an atmosphere in which it was easy to express our opinions.
レポーター:お疲れのところ、ありがとうございました！
Chris: Thank you and good job!

アナウンサー:佐賀教授、このインタビューをお聞きになって、いかがでしょうか。
Chris: Professor Saga, what are your opinions after hearing that interview?
佐賀教授:人を裁くのが怖いと感じるのは当たり前のことですよね。
Chris: Of course judging another person is a frightening thing, isn't it?
佐賀教授:特に、死刑や無期懲役の判決をしなければならないような事件の場合、裁判員の心理的な負担は大きいと思います。
Chris: I think the psychological burden on citizen judges will be particularly heavy, especially in cases in which they must hand down the death penalty or life imprisonment.
アナウンサー:時間的な負担も大きいでしょうね。
Chris: And perhaps it's also a heavy burden on them in terms of time spent?
佐賀教授:そのとおりです。ですから、いろいろな面で裁判員をサポートする体制の確立が急務だと思います。
Chris: Exactly. So I think it's imperative that we establish a system for the citizen judges that supports them on many different levels.
POST CONVERSATION BANTER
Naomi: インタビューでも言っていましたが、「人を裁く」というのは、怖いですよね～。自分の判断が、他の人の人生を変えてしまう・・っていうことですからね。
Natsuko: そうですよね。私だったら、ちょっと重荷に感じてしまいそうだなぁ。
Naomi: 大きな罪なんかの場合は、特に、ちょっと重荷になりますよね。
Chris: 僕は、たまに、あの、被告になった夢を見たりしますね。
Natsuko: え、それで、”guilty” とか言われちゃうんですか。
Chris: もちろんです。
Natsuko/Naomi: え～こわ～い。
Chris: いつも、怖くて。
Naomi: 「被告」っていうのは、前回のレッスンにも出てきましたが、これは英語で(defendant) なんですね。被告になった夢を見ちゃうんですね、クリスさんは。
Chris: いつも汗かいて、起きちゃうんです。
Naomi: こわ～い。あの、個人的にはね。裁判で知った情報は、裁判を終わったあとも、他の人に話しちゃいけない・・・っていうのは、私には、ちょっと、大変な感じに思えるんですけど。
Natsuko: あの、つい話しちゃいそうですよね。
Naomi: ぺらぺらっとね。
Natsuko: そうそう。これ、「守秘義務」っていうんですけど、英語では、
Chris: “confidentiality obligation”
Natsuko: この守秘義務っていうのも、結構大きな負担ですよね。
Naomi: そうですよね。
Natsuko: 話しちゃいけないとか思ってると、いつも気をつけていないといけないですもんね。
Naomi: そうですよね。家族とかに話しちゃいそうですよね。
Natsuko: けど、私たちも、いつ、実際に裁判員に選ばれましたっていう連絡が来るかわからないですから、人ごとじゃないですよね。
Naomi: そうですね。
VOCAB AND PHRASE USAGE
Chris: Let's have a closer look at the usage for some of the words and phrases from this lesson.
Naomi: では、今回も「裁判用語」がいくつか出てきていますので、見ていきましょう。まず最初の単語は、
Natsuko: 「死刑」
Chris: “death penalty”
Naomi: このほかにも、刑の種類が出てきましたね。
Natsuko: 「無期懲役」
Chris: “indefinite imprison term”
Naomi: 二つの単語からできています。まず
Natsuko: 「無期」
Naomi: 「無期」というのは、期限 (limit) がないということですから、「ずっと」という意味。それから、後半の単語は
Natuko: 「懲役」
Naomi: 懲役は刑務所 (prison) に入って、刑務所の中で働かされるという刑なんですね。
Chris: So, 懲役 is "when someone goes to a prison, and has to work from within the prison."
Naomi: だから、「無期懲役」というのは「期限がなく、刑務所の中で働きなさい」という刑なんですね。
Natsuko: そうですね。だから、いつまでという期限を決めないで、刑務所に入って働く。そういう意味なんですね。ただ、日本では、これは、死刑の次に重い刑なんで、よく ”life imprisonment” と同じようなニュアンスで使われるんですけど、正確には、life inprisonmentじゃなくて、20年くらい出ててくることも多いんですよね。ただ、単語の意味としては、期限を決めませんという意味です。
Naomi: はい。
Chris: じゃ、もっと短い時はどう言いますか。例えば、５years' imprisonment.
Naomi: 「懲役五年」
Chris: 英語と順番が逆ですね。「ちょうえき・ごねん」
Natsuko: 英語だと、”5 years” が先に来るんですよね。
Natsuko: 刑務所に入るだけで、働かないという刑もあるんですよ。
Naomi: あ、そうですね。何でしたっけ？
Natsuko: これは、「禁固」
Chris: "imprisonment" but, 禁固 means "being in prison but without having mandatory working service."
Naomi: なつこさん、どうしてそんなに、詳しいんですか。すごい詳しい。。。(笑）
Natsuko: え？いや、別に有罪になったことがあるわけではないんですが。。。(笑）でも、結構意識してると、ニュースとかで流れているんですよね。
Naomi: あ、そうなんですよね。
Natsuko: ところで、「懲役」も「禁固」も、どちらも英語では、”imprisonment” なんですね。
Naomi: あ、そうですね。でも、日本語だと、禁固と懲役、２つの単語になっちゃうんですね。
Natsuko: はい。
Naomi: では、最後にもうひとつ、ニュースや論文などに使われる単語を紹介したいと思います。
Natsuko: 「急務」
Chris: “urgent business”
Naomi: 最初の漢字は「急ぐ」という意味ですよね。二番目の漢字は “task” とか “duty”という意味です。
Natsuko: あ、なるほど。「急務」というのは「急いでしなければいけない事」という意味ですものね。
Naomi: 今回のダイアログでは、どのように使われていました？
Natsuko: 「裁判員をサポートする体制の確立が急務だと思います。」
Chris: “I think it's imperative that we establish the system for citizen judges that support them on many different levels.”
Naomi: よく「～が急務だ」という文型で使われますね。なつこさん、例文をお願いします。
Natsuko: はい。「地球温暖化の対策が急務だ。」
Chris: “It's imperative that we take measures to curb global warming.”
Naomi: 今回のダイアログには、丁寧に人に頼んでいる表現が出てきていました。それを勉強していきましょう。
Chris: The focus of this lesson is a polite request.
Naomi: ダイアログの表現を紹介してください。
Natsuko:「裁判員として、初めて裁判に参加されたご感想をお聞かせ願えますか。」
Chris: "Can we hear your thoughts on participating in a trial for the first time as a citizen judge?"
Naomi: この「お+verb+願えますか」がこのレッスンのポイントです。
Chris: The sentence structure of "お + masu stem of verb + 願えますか" is a super polite request, which means "could you please do something?"
Naomi: 「お/きかせ/ねがえますか」
まず、「お」は尊敬ですね。「聞かせ」は「聞かせる」の masu stem です。「願えますか」は、「願う」の可能形 (potential form) の疑問形なので、「お願いすることができますか」という意味です。
Chris: So お is "honorific prefix," 聞かせる means "to let someone hear" or "to let someone listen." Actually it's a causative form of the verb 聞く"to hear or to listen." And the past part 願えますか means "can I wish." So お聞かせ願えますか basically means "Can we hear..."
Natsuko: 「ご意見をお聞かせ願いますか。」
Chris: “Can we hear your opinion?”
Natsuko: なんて、フォーマルな文書では見ますよね。
Naomi: そうですね。たとえば、会社からお客さんに送ったメールとか、手紙とか。
Natsuko: もちろん、こんなに丁寧に話す必要のない場合には、「お聞かせください」とか、「聞かせてくれますか」で、いいと思いますよ。
Naomi: では、もう少し例文をお聞かせ願えますか。なつこさん。(笑）
Natsuko: かしこまりました。「佐藤さんに、お電話をくださるよう、お伝え願えますか。」
Chris: “Would you please ask Sato-san to call me?”
Naomi: ビジネスでは、この表現はよく聞きますよね。
Natsuko: そうですね。お客さんに対しては、なるべく丁寧な表現を使いますからね。
Chris: Honorific prefix は「お」だけじゃくて、[ご」もありますよね。
Natsuko: さすが、クリスさん。いいポイントですね。
Chris: ありがとうございます。
Naomi: そうなんですよね。「お～願えますか」という形を紹介しましたが、「するverb」の場合、ちょっと注意が必要なんです。「する動詞」、「するverb」のときは masu stem は使わないで、名詞だけを使います。
Natsuko: もうUpper Intermediateを聞いている皆さんは知ってると思いますが、その名詞によって、honorific prefix が「お」になったり「ご」になったりします。
Chris: We introduced that you can express a super polite request "お + masu stem of verb + 願えますか". However in a case of suru verb, you only use the noun. What you do is you add honorific prefix お or ご in front of the noun and add 願えますか after it.
Whether you use お or ご depends on the noun. Basically you need to memorize them one by one.
Naomi: 大変残念なお知らせでしたね。ひとつひとつ覚えなければいけない。
Natsuko: そうなんです。
Naomi: 例えば、「記入する」は
Chris: "To fill out" as in to fill out the form.
Naomi: 記入してください、と丁寧に頼みたいときは、
Natsuko: 「ご記入願えますか。」
Naomi: 「ご+きにゅう+ねがえますか」なんですね。では、例文をお願いします。
Natsuko: 「申し訳ありませんが、こちらの用紙にもご記入願えますか。」
Chris: “I'm terribly sorry, but can you also fill out this form?”
Naomi: もう一つ練習をしてみましょう。「署名する」は？
Chris: "to sign"
Naomi: 署名してください、と丁寧に頼みたい時は？
Natsuko: 「ご署名願えますか。」
Naomi: 「ご/しょめい/ねがえますか」ですね。では、例文をお願いします。
Natsuko:「同意頂ける場合は、こちらにご署名願えますか。」
Chris: “To accept the terms, please sign here.”
Naomi: 「もしよければお願いします」という、なんかすごい丁寧なニュアンスが含まれますよね。
Natsuko: そうですね。
Chris: 覚えておくと、無理なお願いも聞いてもらえるかもしれません。
Natsuko: いや、それはどうかわからないですけど。
Naomi: どうか、わからないですけどね。
Natsuko: でも、丁寧に頼んだ方が絶対に感じがいいですよね。
Naomi: う～ん、そうですね。
Naomi: 裁判員制度をテーマにしたレッスンは、このレッスンで終わりです。
